Terms of Service

1. Acceptance of Terms

By accessing and using Feedix ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a legally binding agreement between you and Feedix. Your continued use of the Service after any modifications to these Terms constitutes your acceptance of such modifications.

2. Eligibility Requirements

To use the Service, you must meet the following requirements:

• You must be at least 13 years of age. If you are under 18, you must have parental or guardian consent.
• You must have a valid Google account to authenticate and access the Service.
• You must have the legal capacity to enter into a binding agreement in your jurisdiction.
• You must not have been previously suspended or removed from the Service.
• If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

3. Description of Service

Feedix is an AI-powered YouTube video summarization service that delivers summaries via email. The Service:

• Uses artificial intelligence to analyze and summarize video content from YouTube channels you select.
• Provides timestamped summaries to help you navigate to specific parts of videos.
• Delivers summaries to your email according to your preferred schedule (daily or weekly).
• Operates in conjunction with the YouTube API Services. By using our Service, you also agree to be bound by the YouTube Terms of Service (https://www.youtube.com/t/terms).

4. User Accounts and Security

You must create an account using Google OAuth to access the Service. Regarding your account:

• You are solely responsible for maintaining the confidentiality and security of your account credentials.
• You are responsible for all activities that occur under your account.
• Account sharing is strictly prohibited. Each account is for a single user only.
• You must immediately notify us of any unauthorized use of your account.
• We reserve the right to suspend or terminate accounts that violate these Terms.

5. Subscription, Payments, and Billing

The Service offers free and paid subscription tiers:

• Free Tier: Provides 30 minutes of video summarization as a one-time trial.
• Pro Tier ($5.90/month): Provides 700 minutes of video summarization per month with additional features.

Regarding billing and payments:

• Paid subscriptions are billed monthly through our payment processor (Dodo Payments) and automatically renew unless cancelled.
• You authorize us to charge your payment method on a recurring basis until you cancel.
• We reserve the right to change subscription prices with 30 days advance notice via email.
• All prices are in USD unless otherwise specified.
• You are responsible for any applicable taxes in your jurisdiction.

6. Prohibited Activities

You agree NOT to engage in any of the following prohibited activities:

• Using bots, scrapers, or automated tools to access the Service beyond normal usage.
• Reverse engineering, decompiling, or attempting to extract the source code of the Service.
• Circumventing usage limits, quotas, or security measures.
• Sharing, reselling, or redistributing AI-generated summaries for commercial purposes without authorization.
• Using the Service to summarize content that infringes on third-party copyrights or intellectual property.
• Interfering with or disrupting the Service, servers, or networks connected to the Service.
• Impersonating another person or entity, or misrepresenting your affiliation.
• Using the Service for any illegal purposes or in violation of any applicable laws.
• Creating multiple accounts to circumvent usage limits or suspension.
• Attempting to gain unauthorized access to other users' accounts or data.

7. AI-Generated Content Disclaimer

Regarding the AI-generated summaries provided by the Service:

• Summaries are generated by artificial intelligence and may not perfectly capture all nuances or context of the original video content.
• We do not guarantee the accuracy, completeness, or reliability of AI-generated summaries.
• Summaries should not be used as a substitute for professional, legal, medical, financial, or other expert advice.
• The original video content remains the property of its respective creators. Summaries are derivative works for personal informational use only.
• You should verify important information by watching the original video content.

8. Third-Party Services and APIs

The Service integrates with third-party services:

• YouTube API Services: By using Feedix, you agree to be bound by the YouTube Terms of Service. You can revoke Feedix's access to your YouTube data at any time via Google Security Settings (https://security.google.com/settings/security/permissions).
• Google OAuth: We use Google for authentication. Your use is subject to Google's Terms of Service and Privacy Policy.
• Dodo Payments: Payment processing is handled by Dodo Payments, subject to their terms and conditions.
• We are not responsible for the practices, content, or policies of any third-party services.

9. Intellectual Property Rights

Regarding intellectual property:

• The Service, including its design, features, and functionality, is owned by Feedix and protected by international copyright, trademark, and other intellectual property laws.
• You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes.
• Original YouTube video content remains the intellectual property of its respective creators.
• You may not copy, modify, distribute, or create derivative works based on the Service without our express written permission.

10. Service Modifications and Availability

We reserve the right to:

• Modify, suspend, or discontinue any part of the Service at any time without prior notice.
• Perform scheduled or unscheduled maintenance that may result in service interruptions.
• Update or change features, functionality, or user interface of the Service.
• We will make reasonable efforts to notify users of significant changes that materially affect the Service.
• We are not liable for any modification, suspension, or discontinuation of the Service.

11. Termination

Regarding termination of your account or access:

• You may terminate your account at any time by contacting us at support@feedix.app or through account settings.
• We may suspend or terminate your access immediately, without prior notice, if you violate these Terms.
• Upon termination, your right to use the Service ceases immediately.
• We may retain certain data as required by law or for legitimate business purposes.
• Provisions of these Terms that should survive termination will remain in effect.

12. Disclaimer of Warranties and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

• We do not warrant that the Service will be uninterrupted, error-free, or secure.
• IN NO EVENT SHALL FEEDIX BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES.
• Our total liability shall not exceed the amount you paid for the Service in the 12 months preceding the claim.
• Some jurisdictions do not allow limitation of liability, so these limitations may not apply to you.

13. Indemnification

You agree to indemnify, defend, and hold harmless Feedix and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or in connection with: (a) your use of the Service; (b) your violation of these Terms; (c) your violation of any third-party rights; or (d) any content you submit or transmit through the Service.

14. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea, without regard to its conflict of law provisions.

• Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of the Republic of Korea.
• Before initiating any formal legal proceedings, you agree to first attempt to resolve disputes informally by contacting us at support@feedix.app.
• For users in the European Union, you may also be entitled to submit disputes to the EU Online Dispute Resolution platform.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email at least 30 days before the changes take effect. Your continued use of the Service after the effective date of any changes constitutes your acceptance of the modified Terms. If you do not agree to the modified Terms, you must stop using the Service and may request account deletion.

16. General Provisions

• Entire Agreement: These Terms constitute the entire agreement between you and Feedix regarding the Service.
• Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in effect.
• Waiver: Our failure to enforce any provision of these Terms does not constitute a waiver of that provision.
• Assignment: You may not assign your rights under these Terms without our prior written consent.
• Force Majeure: We are not liable for any failure to perform due to causes beyond our reasonable control.
